By accessing or using EchoGrade, you agree to be bound by these Terms of Service. If you do not agree, you must not use the service.

2. Eligibility

EchoGrade is intended for users aged 18 years and older. By using the service, you confirm that you meet this requirement.

3. Description of Service

EchoGrade provides AI-powered TOEFL speaking practice, including spoken response submission, feedback, estimated scores, and progress tracking.

4. No Affiliation Disclaimer

EchoGrade is an independent tool and is not affiliated with, endorsed by, or approved by Educational Testing Service. TOEFL® is a registered trademark of ETS.

5. AI Disclaimer

EchoGrade uses artificial intelligence to generate feedback and estimated scores. Results are simulated, approximate, and may not reflect official TOEFL scoring.

6. No Guarantee of Results

EchoGrade does not guarantee score improvement, passing any exam, or perfect accuracy of feedback. Use of the service is for practice and educational purposes only.

7. User Accounts

You are responsible for maintaining the confidentiality of your account and for all activities under your account.

8. User Content

You retain ownership of the content you submit, including voice recordings. By using EchoGrade, you grant us permission to process your content, temporarily access microphone input for recording responses, analyze submissions, and generate feedback for providing and improving the service.

9. Intellectual Property

EchoGrade, including its software, branding, design, content, and platform features, is owned by EchoGrade and protected by intellectual property laws. Users may not copy, reproduce, distribute, modify, or reverse engineer any part of the service without permission.

10. Acceptable Use

• Do not use EchoGrade for illegal purposes.
• Do not upload harmful, abusive, or disruptive content.
• Do not attempt to hack, overload, or disrupt the platform.
• Do not misuse AI outputs.

11. Payments and Subscriptions

Subscription payments are processed through Stripe or other secure payment providers. Pricing, billing cycles, and included features are shown before purchase.

Subscriptions may renew automatically unless canceled before the next billing cycle. Users are responsible for managing or canceling subscriptions through their account settings or payment provider.

EchoGrade does not store full credit card information.

12. Refunds

Unless otherwise stated, purchases may be non-refundable. Refunds, if offered, are handled at our discretion or according to applicable law.

13. Termination

We may suspend or terminate accounts that violate these Terms. You may stop using EchoGrade at any time.

14. Account Deletion

Users may request deletion of their account and associated personal data by contacting support@echograde.ai. Certain information may be retained where required for legal, security, or operational purposes.

15. Limitation of Liability

To the fullest extent permitted by law, EchoGrade and its operators shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of the service, including reliance on AI-generated feedback, estimated scores, interruptions, inaccuracies, or loss of data.

Use of EchoGrade is at your own risk.

16. Privacy

Your use of EchoGrade is also governed by our Privacy Policy.

17. Changes to Terms

We may update these Terms from time to time. Continued use of EchoGrade after changes means you accept the updated Terms.

18. Dispute Resolution

Any dispute arising from these Terms or use of EchoGrade shall be resolved through binding arbitration in California, except where prohibited by law. Users agree to waive participation in class-action lawsuits to the extent permitted by applicable law.

19. Governing Law

These Terms are governed by the laws of the State of California, United States.
